Parker Dairies Terms And Conditions Of Sale

 

1. Introduction

1.1. These Terms and Conditions are for Everelm Ltd T/A Parker Dairies company number 03980073, with registered office at 46-54 High Street, Ingatestone, Essex, CM4 9DW , United Kingdom

1.2. These Terms and Conditions govern the supply and delivery of fresh milk and other produce offered by Parker Dairies to your home, school, or workplace.

1.3. Please read these Terms and Conditions carefully before placing an order. By registering via our customer portal and/or purchasing goods from Parker Dairies, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Orders

2.1. All prices for produce are displayed on our customer portal and website and are inclusive of VAT where applicable.

2.2. We reserve the right, at our sole discretion, to accept or decline any application to sign up or place orders through our customer portal. This may include, for example, declining service if your address is outside our designated delivery areas.

2.3. Once we accept your order, a legally binding contract is formed between you and Parker Dairies under these Terms and Conditions. You are then responsible for settling your account on a weekly or fortnightly basis, using any of the following payment methods: online via our portal or app, over the phone, by cheque, or in person.

2.4. All prices are subject to change. Any changes to pricing will be communicated via our website and/or customer portal in advance where practicable.

2.6. Unless you instruct us otherwise, your order will be treated as a recurring weekly order for the same volume and type of produce. You may manage or amend your Recurring Order at any time through the customer portal or by contacting us via phone or email.


3. Deliveries

3.1. Deliveries are made by our drivers on specific days of the week, depending on your location.

3.2. Deliveries may take place during the night or early morning and are typically left on your doorstep or designated delivery point. Due to the delivery schedule, it is unlikely our drivers will see or interact with you in person. If you are going to be away (e.g., on holiday), it is your responsibility to pause or amend your order via the portal or by contacting us directly.

3.3. We reserve the right to suspend deliveries and take appropriate action if payment is not received by the due date.

3.4. Orders may only be placed via the portal if your address falls within our designated delivery areas. However, we retain absolute discretion to accept or decline any new customer sign-ups.

3.5 Deliveries will be made to your address as registered in your account. You must provide Parker Dairies with accurate information. Should you have any specific delivery instructions, please inform us through the website, telephone, email or leave a note directly for your milky.

3.6 You are not required to be present to accept delivery. Deliveries are typically made during the night or early morning hours, and as such, your order will be left at your doorstep or other designated delivery location. If you are planning to be away (e.g. for a holiday), you must notify us in advance by marking the relevant dates in the customer portal. We will not be held responsible for missed or spoiled deliveries if you fail to inform us.

3.7 If you change your delivery address, you must update your account details notifing us directly via email or telephone. Failure to update your address may result in missed deliveries, for which we accept no liability.

4. Your Responsibilities

4.1. You are responsible for ensuring that all personal and account information entered on the customer portal is accurate and kept up to date at the time of registration and thereafter.

4.2. You must ensure that your property is safe and accessible for our drivers and suitable for the receipt of perishable goods.

4.3. You agree to comply with these Terms and Conditions in full, as amended from time to time

 

5. Our Responsibilities

5.1 We are responsible for any predictable loss of produce you experience. However, we are not accountable for losses that were unforeseeable, resulted from factors beyond our control, or could have been prevented by you taking reasonable precautions

 

6. Changes to Produce and Delivery

6.1. We reserve the right to modify, suspend, or update the produce we offer.

6.2. If we suspend or cancel the supply of any products you have paid for in advance, we will issue a full refund for the affected items.

6.3. We may restrict or cease deliveries to certain areas at our discretion. In such cases, reasonable notice will be provided where practicable, and any prepayments will be refunded accordingly.


7. Late Payments

7.1. You agree to reimburse us in full for any reasonable costs, expenses, or other outgoings incurred by us in recovering outstanding payments from you, including but not limited to administrative fees, legal fees, and third-party collection charges, in the event of a failed or missed payment.

 

8 VAT

8.1 If the rate of Value Added Tax (VAT) changes between the date you place your order and the date the product is supplied, we will adjust the VAT you pay accordingly—unless you have already paid in full prior to the effective date of the VAT rate change.

 

9. Delays

9.1 We are not responsible for delays outside of our control. If our supply of the produce is delayed by an event outside of our control, we will aim to leave a note for you or in occasion email you to inform you. If the delay is significant, you can contact the team and receive a refund for the items you have paid for but not received.

 

10. Your Legal Rights

10.1. You acknowledge and agree that, due to the fresh and perishable nature of the produce, the statutory cancellation rights and 14-day “cooling-off” period under the Consumer Contracts Regulations 2013 do not apply. This exemption is in accordance with Regulation 28(1)(c), which excludes goods that are liable to deteriorate or expire rapidly.

10.2. If you believe that a product is faulty, not as described, or otherwise fails to meet the standards required under the Consumer Rights Act 2015, you must notify Parker Dairies without undue delay. Under the Act, you may be entitled to a refund, replacement, or repair depending on the nature of the issue and the timing of the complaint.

10.3. Given the perishable nature of the produce, any concerns must be reported before the “Use By” date (or equivalent expiry indicator) to enable us to assess your entitlement to a remedy.
 

11 Termination of Contract

11.1. You have the right to close your account and end your contract with us at any time. Please contact our customer service team to do so.

11.2. We may terminate the contract if payment remains unpaid 14 days after a formal reminder is issued. You will be notified of such action.


12. Complaints

12.1. If you have any complaints or concerns, please contact us directly. We are committed to addressing and resolving any issues you may have with our service or the produce provided.

 

13. Website Use

13.1. We are the sole owner or licensed holder of all intellectual property rights associated with this website and the content published on it. These works are protected by applicable copyright laws and international treaties. All rights are reserved.
